§ 16. Enactment of ordinances.

  • (a)

    The enactment of all ordinances and resolutions by the Town of Longboat Key shall be in substantial conformance with state law.

    (b)

    The majority of the members of the town commission shall constitute a quorum. A lesser number may adjourn from day to day and compel the attendance of absent members in such a manner and under such penalties as may be prescribed by ordinance. The affirmative vote of not less than four (4) members shall be necessary to adopt any ordinance or resolution and the passage of all ordinances shall be taken by "yeas" and "nays" and entered in the minutes. On final passage, the vote of each member of the town commission voting shall be entered on the official record of the meeting. All ordinances or resolutions passed by the town commission shall become effective ten (10) days after passage or as otherwise provided therein. Should an ordinance or resolution receive an affirmative vote of less than four (4), but the affirmative votes of enough when added to the absent members to make four (4), the ordinance or resolution shall be rescheduled from meeting to meeting until the matter can be decided by a concurring vote of four (4) or more members of the commission.

    (c)

    Every ordinance or resolution shall upon its final passage shall be signed by the mayor and the town clerk and kept as required by applicable Florida law.

    (d)

    Codes, including the building code and other codes of the Town of Longboat Key, which are in printed form or in digital format and are on file and available for public inspection at the office of the town clerk, need not be published in a newspaper in order to become effective, but may by reference be made a part of any town ordinance now or hereafter adopted.
